Implemental Rule for the arrangements of Compulsory Product Certification System
In order to ensure the transition of certification system from Import Goods Safety Quality Permission System and Product Safety Certification Compulsory Supervision System ('old system' as following) to Compulsory Product Certification System ('new system' as following), and protect the legal rights of all aspects, the arrangements as following:
Note: Import Goods Safety Quality Permission System was organized by former China Export / Import Inspection & Quarantine Bureau.
Product Safety Certification Compulsory Supervision System was organized by former National Quality & Technology Supervision Bureau.
1. Implementation of new system and abolishment of old system
New system was implemented since 1st May, 2002; old system was abolished from 1st May, 2003.
2. Supervision management for the product which suits both new and old system
1) Since 1st May, 2003, the product in 'Catalogue' can be manufactured/imported by domestic enterprise only when they have certificate of China Compulsory Certification (abbr. 'new certificate' as following), and with the Compulsory Certification Mark (abbr. 'new mark' as following) on the products.
2) Since 1st May, 2003, dealer/importer should not buy/import/sell products in 'Catalogue' without new certificate and new mark. The products in 'Catalogue' with Safety Quality License of import product/CCIB Mark/Eligibility License of Safety Certification/Grate Wall Mark (abbr. 'old certificate', 'old mark' as following) which were bought/imported before 30th April, 2003 but haven't been sold, should record to local quality inspection department first, and sold under the supervision of local quality inspection department.
3) Since 1st May, 2003, if the product with new certificate and new mark want to use the outer packing with old mark, it can be manufactured/imported/sold only when they were covered with new mark.
4) Before 30th April, 2003, the products in 'Catalogue' which should have old certificate and old mark formerly, can be manufactured/imported/sold depends on old certificate and old mark/new certificate and new mark.
5) Since 1st May, 2002, the products which have had old certificate and old mark must not be ranked in 'Catalogue' this time, its old certificate and old mark will no longer be the agreement for manufacture/import/sale.
3. Accept application for certification
1)Since May 1, 2002, certification institute authorized by State Certification and Accreditation Administration (abbr. 'authorized certification institute' as following) start to accept the application of new certificate and new mark for the products in 'Catalogue', and do not accept the application of old certificate and old mark no longer.
2) Before April 30, 2002, the products in 'Catalogue' which should have had old certificate and old mark continue to applying for old certificate and old mark.
4. Other items
1) The product in 'Catalogue' which has applied for but hasn't/has got old certificate, can have new certificate and use new mark after being confirmed by authorized certification institute, and applicant should apply for the certification first.
2)The charge for applying for new certificate and new mark above should be paid by applicant in accordance with items actually happened and the charge standard of new system.
