Notice of Related Problems of Carrying Out Compulsory Certification System
Each Quality/Technology Supervision Bureau, each Inspection and Quarantine Bureau, each related units of Province/municipality/city directly under the jurisdiction of Central Government:According to the rules of compulsory certification systems (hereafter referred to 'New Systems' as abbreviated) such as 'Compulsory Product Certification Management Regulations', 'Compulsory Product Certification Mark Management Measure' , 'The First Compulsory Certification Product Catalog' (hereafter referred to 'Catalog' as abbreviated) which issued by AQSIQ and CNCA, now we inform you of related problems about the transition arrangement of the new systems and imported goods safety/quality accredited systems which issued/organized to implement by former China Imported and Exported Inspection and Quarantine Bureau, and product safety certification compulsory supervision management systems which issued/organized to implement by former China Technology Supervision Bureau (hereafter referred to 'Old Systems' as abbreviated):
1 Enforcement of new systems and abolish of old systems
According to <Compulsory Certification Management Regulations>, new systems will be implemented since May 1, 2002. To ensure the smooth transition of new systems and old systems and assert legal rights of all parties concerned, old systems will be abolished since May 1, 2003.
2 Supervision and management of products adapted by new systems and old systems
1) Since May 1, 2003, products listed in <Catalog> can be left from China enterprises or imported from oversea, only if these products obtain certificate (hereafter referred to 'new certificate' as abbreviated) and be labeled compulsory certification mark (hereafter referred to 'new certification mark' as abbreviated).
2) Since May1, 2003, dealer and importer could not stock/import/sell products listed in <Catalog> which has not obtained new certificate and not labeled new mark. The products listed in 'Catalog' which have been stocked/imported but have not been sold and have obtained imported goods safety/quality accreditation certificate and CCIB mark/safety certification certificate and Great Wall mark (hereafter referred to 'old certificate'/'old certification mark' as catchall) before April 30, 2003, should be registered in local quality inspection department before being sold under the supervision/management of quality inspection department.
3) Since May 1, 2003, products which obtained new certificate/new mark should be labeled new mark before leaving the factory, imported and being sold if they still use outer pack printed old mark.
4) Before April 30, 2003, products listed in 'Catalog' which should obtain old certificate/old mark formerly could leave the factory, imported and be sold by old certificate/old mark or new certificate/new mark.
5) Since May 1, 2002, products which should obtain old certificate/old mark formerly could not be listed in <Catalog>, the old certificate/old mark will no longer required for the products leaving the factory, imported and be sold.
3 Accept of certification application
1) Since May 1, 2002, certification institute which are designated by CNCA (hereafter referred to 'designated certification institute' as abbreviated)will begin to accept new certificate/new mark application of products listed in 'Catalog', and no longer accept application of old certificate/old mark.
2) Before Apr30, 2003, products listed in <Catalog> which should obtain old certificate/old mark formally could go on applying for old certificate/old mark.
4 Other items
1) Products listed in 'Catalog' which applied for but have not obtained or have obtained old certificate, could obtain new certificate and use new mark only if raising a application by applicant and confirming they meet conditions by designated certification institute.
2) Fee of obtaining above-mentioned new certificate/new mark is paid by applicant according to actual occurrence of items and charge standard of new system.
